in america, it would be a little of both their faults. insurance companies will call and blah blahhhh, and they will find the biker about 20 or so percent responsible b/c he was driving wreckless-ly, and the car b/c he made the turn without checking if it was clear. yeaup, it was the cars fault, but if your speeding or doing something wrong, like saying you were on the phone, and looking the other way, then you can still be a percentage at fault. XP insurance companies suckkk

Lane splitting is what motorcycles are EXPECTED to do in Japan to alleviate traffic. Idiotic drivers that can't pay attention to their surroundings are the only ones that have a problem with this concept.
